Terms & Conditions

1. Welcome to HEKMA 

    • These Terms of Use (“Terms”) govern your use of the HEKMA Patient Platform — the web-based tools and services designed to help you discover clinical trials, manage your Health Passport, and connect with research sites. By creating an account and using the Patient Platform, you agree to these Terms.

    • HEKMA’s Patient Platform is available in English, Arabic, and Spanish. If you have questions about these Terms, please contact us at patients@hekma.io.

 

2. Who Can Use the Patient Platform 

The Patient Platform is available to: 

    • Individuals aged 18 or older in the United States or United Arab Emirates seeking to find and participate in clinical trials 

    • Caregivers managing trial enrollment on behalf of a family member or dependent (a “Caregiver Account”) 

    • Patient Advocacy Group (PAG) members registered through a partner PAG organization 

For Caregiver Accounts: You confirm that you have the legal authority to act on behalf of the individual whose health information you are entering, and that the individual has consented or you are their legal guardian. 

 

3. Your Health Passport 

The HEKMA Health Passport is your personal, portable health profile that helps match you to relevant clinical trials. By using the Health Passport: 

    • You authorize HEKMA to use the health information you provide to generate clinical trial match recommendations through the AI TrialMatch Engine 

    • You may update, correct, or delete your Health Passport information at any time from your account settings 

    • Your Health Passport data belongs to you — HEKMA will never sell it to third parties 

    • Sharing your Health Passport with a research site requires your explicit, step-by-step consent within the platform 

 

4. AI Trial Matching — Important Notice 

HEKMA’s Ask HEKMA AI and AI TrialMatch Engine are decision-support tools. They are not medical devices and do not provide medical advice. Matching outputs are recommendations only and do not guarantee eligibility for or acceptance into any clinical trial. You should always discuss clinical trial participation with your physician or healthcare provider before enrolling. 

 

5. Your Account Responsibilities 

    • You are responsible for maintaining the security of your account credentials 

    • You agree to provide accurate, truthful information in your Health Passport and profile 

    • You will not create multiple accounts or impersonate another person 

    • You will not attempt to access areas of the platform not intended for patient users 

    • You will notify us immediately at patients@hekma.io if you suspect unauthorized access to your account 

 

6. Content & Communications 

HEKMA may send you the following types of communications: 

    • Trial match notifications: When your Health Passport matches a new clinical trial (you can turn these off in settings) 

    • Updates about trials you have expressed interest in 

    • Platform feature announcements and educational content 

    • Required account and security communications that cannot be turned off 

We will never send you marketing messages from Sponsors without your explicit consent. 

 

7. Third-Party Links & Content 

The Patient Platform may include links to ClinicalTrials.gov, research institution websites, or PAG partner sites. HEKMA is not responsible for the content or privacy practices of these third-party sites. Clicking on these links takes you away from the HEKMA platform. 

 

8. Patient Advocacy Group (PAG) Partnerships 

If you have joined the HEKMA Patient Platform through a PAG partner organization: 

    • Your PAG partner may have a separate privacy notice describing how they use your data 

    • HEKMA and your PAG partner have agreed on the terms of data sharing in a formal Data Sharing Agreement 

    • HEKMA’s PAG Transparency Dashboard allows you to see what data your PAG partner can access 

 

9. Intellectual Property 

The HEKMA platform, including all AI tools, matching algorithms, and design elements, is owned by HEKMA. Your use of the platform does not grant you any rights in HEKMA’s intellectual property. Content you provide (health data, journal entries) remains yours. 

 

10. Limitation of Liability 

HEKMA provides the Patient Platform to help you find and learn about clinical trials. We are not a healthcare provider, sponsor, or clinical trial operator. We are not responsible for decisions made by research sites or sponsors about your eligibility. Our liability to you is limited to direct losses arising from our own negligence. 

 

11. Withdrawing from the Platform 

You may close your HEKMA Patient account at any time from your account settings. Upon account closure, your Health Passport and personal data will be deleted within thirty (30) days, except where retention is required to comply with applicable law or to fulfill regulatory obligations related to any trial in which you have been enrolled. 

Note: Closing your HEKMA account does not automatically withdraw you from any clinical trial in which you are enrolled. Contact the research site directly to withdraw from a trial. 

 

12. Changes to These Terms 

We will notify you by email or in-platform notification at least thirty (30) days before making material changes to these Terms. Continuing to use the Patient Platform after the effective date of changes means you accept the updated Terms.
